Alito has finally published his dissent from the Supreme Courts emergency order last night. Its joined by Thomas, and accuses the majority of violating multiple procedural rules in its race to halt unlawful deportations.

(60,788 posts)to act quickly in the middle of the night. That even one person would be sent to a prison for an indefinite time in a foreign country with no due process should have been enough.

Under the Trump administrations theory of the law, the government could have banished this U.S. citizen to a Salvadoran prison then refused to do anything to bring him back.
This is why the Constitution guarantees due process to all. Could it be more obvious?
