Alito has finally published his dissent from the Supreme Court’s emergency order last night. It’s joined by Thomas, and accuses the majority of violating multiple procedural rules in its race to halt unlawful deportations.

to act quickly in the middle of the night. That even one person would be sent to a prison for an indefinite time in a foreign country with no due process should have been enough.

...Alito and Thomas would be looking for ways to approve of it. They wouldn't prevail, God willing---but the effort would be there.

Under the Trump administration’s theory of the law, the government could have banished this U.S. citizen to a Salvadoran prison then refused to do anything to bring him back.

This is why the Constitution guarantees due process to all. Could it be more obvious?
