1. If the accused is a national of a state party (I.e. a signatory to the Rome Statute).
2. If the crime took place on the territory of a state party, regardless of the perpetrator's nationality.
3.If the UN Security Council refers a situation to the ICC, even if the country is not a party.
NOTES:
El Salvadore is a State Party the ICC, having ratified the Rome Statute on 3/3/2016.
According to an interview with Kristen Welker, NBC News, Donald Trump stated that Jack Smith is returning to The Hague, but "he can be dangerous there too."

Who's going to arrest Trump in the real world? The US doesn't even recognize the ICC, they have zero real power.
