UPDATE: Chief Judge Boasberg schedules a hearing for 4p today on the government's notice and the plaintiffs' response, notes that the gov't "shall be prepared to provide answers to the questions raised by Plaintiffs on page 6 of their Response."

Here are those questions:
In sum, given the careful phrasing of the government's letter, the publicly available data,
the government's own statements, and the numerous media reports that the government may
have chosen not to abide by the Court's Order, Plaintiffs request that the Court immediately

direct the government to submit one or more sworn declarations from individuals with direct
knowledge of the facts clarifying the following:
1) whether any flight with individuals subject to the Proclamation took off after either the
Court's written or oral Orders were issued;
2) whether any flight with individuals subject to the Proclamation landed after either the
Court's written or oral Orders were issued;
3) whether any flight with individuals subject to the Proclamation was still in the air after
either the Court's written or oral Orders were issued; and
4) whether custody of any individuals subject to the Proclamation was transferred to a
foreign country after either the Court's written or oral Orders were issued.

ACLU asks judge to force the Trump administration to state under oath if it violated his court order

Plaintiffs in a lawsuit filed to halt deportations under a rarely-used 18th century wartime law invoked by President Donald Trump asked a federal judge Monday to force officials to explain under oath whether they violated his court order by removing more than 200 people from the country after it was issued and celebrating it on social media.

The motion marks another escalation in the battle over Trump’s aggressive opening moves in his second term, several of which have been temporarily halted by judges. Trump’s allies have raged over the holds and suggested he does not have to obey them, and some plaintiffs have said it appears the administration is flouting court orders.

On Saturday night, District Judge James E. Boasberg ordered the administration not to deport anyone in its custody over the newly-invoked Alien Enemies Act, which has only been used three times before in U.S. history, all during congressionally-declared wars. Trump issued a proclamation that the 1798 law was newly in effect due to what he claimed was an invasion by the Venezuelan gang, Tren de Aragua.

Trump’s invocation of the act could allow him to deport any noncitizen he says is associated with the gang, without offering proof or even publicly identifying them. The plaintiffs filed their suit on behalf of several Venezuelans in U.S. custody who feared they’d be falsely accused of being Tren de Aragua members and improperly removed from the country.

Weather, financial happenings, plane crashes, shootings -- 100 percent news and deserving of exposure.

But the legal stuff turns on fine distinctions, and there are so many twists and turns happening, especially in the last 52 days, if you catch my drift, that they should get their own place. The big thing that sets them apart from the other news is that are reported on within seconds at Bluesky, and the news source story might not appear for hours. Bluesky is really shining here.

I work across the street from the Prettyman Courthouse. This hearing will bring out the crowds.

Those who carried out illegal orders should face penalties almost as severe as if they had acted alone. Only when faceless LEOs are held responsible for their mindless obedience to a corrupt regime will these lawless policies become unenforcable. Of course, anyone who wants to try to mitigate his sentence can testify against his superiors, and bring receipts.

Lawyers and civil servants are resigning their positions rather than violate the Constitution. It is an offense against American principles that LEOs aren't doing the same.

The district court's hasty public inquiry into these sensitive national security matters-with no contemplated protections against disclosure of operational details—underscores the urgency of immediate relief from this Court, including an immediate administrative stay that would allow

further briefing to unfold in an orderly and appropriate manner and prevents the district court from further efforts to interfere with President Trump's core Article II authorities, including the conduct of foreign policy. This Court should also immediately reassign this case to another district court judge given the highly unusual and improper procedures—e.g. certification of a class action involving members of a designated foreign terrorist organization in less than 18 hours with no discovery and no briefing from the Government-that have been employed in the district court proceedings to date.
