Judge Halts Trump's Anti-Voting Executive Order

A federal judge in Washington, D.C., Thursday blocked federal agencies from carrying out parts of President Donald Trump's sweeping executive order on elections.
The Democratic Party, the League of United Latin American Citizens, the League of Women Voters Education Fund and others are challenging Trump's order as an unprecedented assault on states' constitutional authority to run their own elections.
District Judge Colleen Kollar-Kotelly, appointed by former President Bill Clinton, granted the groups' request for a preliminary injunction against several parts of Trump's order but allowed other provisions to remain in effect.
Among its many changes, Trump's order directed the U.S. Election Assistance Commission (EAC) -- an independent bipartisan agency -- to change a federal voter registration form to require eligible voters to show proof of citizenship.
The requirement would bar millions of voters who lack easy access to citizenship documents from using the National Mail Voter Registration Form and could force states to rapidly shift their registration procedures. If states don't or can't comply, Trump's order directs the EAC to punish them by withholding federal funding.
Judge Kollar-Kotelly said EAC commissioners and other senior commission officials are barred from taking steps to add a proof of citizenship requirement to the form.

The Democratic Party Plaintiffs Motion is GRANTED as to Section 2(d) of Executive
Order 14,248. Defendants Department of Defense, Department of Veterans Affairs,
Department of the Interior, Small Business Administration, Peter Hegseth in his official
capacity as Secretary of Defense, Douglas Collins in his official capacity as Secretary of
Veterans Affairs, Douglas Burgum in his official capacity as Secretary of the Interior, and
Kelly Loeffler in her official capacity as Small Business Administrator, are
PRELIMINARILY ENJOINED from taking any action to implement or give effect to
Section 2(d) of Executive Order 14,248, including failing to provide the federal voter
registration application form described in 52 U.S.C. § 20508(a)(2) or an equivalent form
to any applicant for service or assistance based on an inability to assess citizenship.

When Elias Law Group filed the lawsuit last month, the New York Times reported that the lawsuit represents one of the first moments where seemingly every arm of the party is pushing back with one voice since President Trump took office.

We welcome the Courts decision to block multiple provisions of President Trumps illegal Executive Order, said Elias Law Group partner Lali Madduri. This injunction makes clear that the President does not have the authority to unilaterally change the laws governing federal elections. U.S. District Judge Colleen Kollar-Kotelly ruled that multiple provisions of the executive order exceed presidential authority and infringe upon powers constitutionally reserved for Congress and the states. The judge's ruling specifically blocks implementation of the documentary proof-of-citizenship requirement for the national voter registration form, and a requirement that federal voter registration agencies assess citizenship before providing voter registration forms.
"Our Constitution entrusts Congress and the states not the president with the authority to regulate federal elections," Judge Kollar-Kotelly wrote in a 120-page opinion. "And no statutory delegation of authority to the Executive Branch permits the president to short-circuit Congress's deliberative process by executive order."
Other challenged provisions of the Executive Order will remain unblocked while the litigation proceeds.
