U.S. judge issues order stopping the deportation of Boulder suspect's family

BOULDER, Colo. A federal judge issued an order Wednesday to prevent the deportation of the wife and five children of an Egyptian man charged in the firebombing attack in Boulder, Colorado. U.S. District Judge Gordon P. Gallagher granted a request from the family of Mohamed Sabry Soliman to halt deportation proceedings of his wife and five children who were taken into federal custody Tuesday by U.S. immigration officials.
The family members have not been charged in the attack on a group demonstrating for the release of Israeli hostages in Gaza. Soliman faces federal hate crime charges and state charges of attempted murder in the Sunday attack in downtown Boulder. U.S. Secretary of Homeland Security Kristi Noem said Wednesday that they are being processed for removal proceedings. Its rare that family members of a person accused of a crime are detained and threatened with deportation.
Solimans wife, 18-year-old daughter, two minor sons and two minor daughters all are Egyptian citizens, the Department of Homeland Security said in a statement. We are investigating to what extent his family knew about this heinous attack, if they had knowledge of it, or if they provided support to it, Noem said in a statement.
Noem also said federal authorities will immediately crack down on people who overstay their visas in response to the Boulder attack. Soliman told authorities that no one, including his family, knew about his planned attack, according to court documents that, at times, spelled his name as Mohammed.

But a 10-minute hearing on whether they overstayed their tourist Visa IS due process. What more do you want?
BTW Im here because Im a lifelong Democrat since first voting for Jimmy Carter in 1980.
The Court finds that deportation without process could work irreparable harm and an order must issue without notice due to the urgency this situation presents, Gallagher wrote in the order issued at 2:01 p.m.

Maybe the family is as surprised as everyone else at what happened, or maybe they're accomplices. That's why we have law enforcement and courts and stuff.

What I read was that the suspect's family was being processed for expedited removal, which would allow authorities to rapidly deport them without a hearing in an immigration court. In other words, without finding out whether they had overstayed their visas, etc. and/or had any involvement in the suspect's attack. Which is why the judge correctly put the process on hold.

(36,651 posts)if they've all (mostly mom, LBH) overstayed tourist visas and their asylum claims have been rejected, then sure, deport. I haven't seen anything that indicates they have or haven't been granted asylum.

Do they get special treatment now and get to stay because the husband is a terrorist?

45's loons have been steadily deporting people who "had their papers" and even some who were born and raised here and were citizens.

(566 posts)I'm fine with investigating them, that's what they do with every family and associate of terror suspects but I have yet to find any details about their status. We found out immediately that his visa expired on March 28th, did theirs? If their visa's haven't expired did they get revoked? If they didn't then how is ICE/DHS holding them?

....outside of a fascist regime or dictatorship.
We really need to remember who these milquetoast reporters and news outlets are when this is all over. It is insulting to think they are not aware of what they are doing (and not doing).
