California sues Trump admin over National Guard deployment in Los Angeles amid ICE protests

The state of California sued the Trump administration on Monday for deploying the state’s National Guard in Los Angeles amid protests against federal immigration raids.

The lawsuit, filed by California Attorney General Rob Bonta on behalf of the state, accuses the Trump administration of infringing on California Gov. Gavin Newsom’s authority as commander-in-chief of the California National Guard.

“President Trump’s order calling federalized National Guard troops into Los Angeles — over the objections of the Governor and local law enforcement — is unnecessary and counterproductive,” Bonta said in a statement Monday.

He continued, “Let me be clear: There is no invasion. There is no rebellion. The President is trying to manufacture chaos and crisis on the ground for his own political ends. Federalizing the California National Guard is an abuse of the President’s authority under the law — and not one we take lightly. We’re asking a court to put a stop to the unlawful, unprecedented order.”......

In its lawsuit, the state of California accuses Trump of violating the Constitution’s 10th Amendment, which states “the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

I think the Complaint correctly states the law. My only critique is that the Posse Comitatus Act got only a passing mention.
