(124,349 posts)4. If a prosecutor doesn't take a case at all, it doesn't even get to
the point of dismissal. There's no such thing as an independent prosecutor; by definition all prosecutors represent some governmental entity (a state, the federal government, etc.). If a federal prosecutor decides not to go forward with a prosecution pursuant to a federal statute, a state prosecutor might take the case anyhow if there is a corresponding state statute that might have been violated, and it would be entirely out of the hands of the federal prosecutor.
