Valley city attorney to resign following recall election
OMAHA, Neb. (WOWT) - Valley City Attorney Jeff Farnham tells First Alert 6 this is uncharted territory for the city to have both the Mayor and City Council President removed.
“Before we knew the results of the recall election there were three possibilities. The mayor would be recalled and not the councilman, the councilman would be recalled and not the mayor, or they would both be recalled,” explained Farnham.
Farnham explains further that “The law is pretty clear in the individual consequences if the mayor is recalled, the president of the council moves up into the position of mayor creating a vacancy on the council.”
“If a council person is recalled there is a statutory procedure where notice of the vacancy is given to the council, part of the record, and a notice is published and then at the next meeting, the mayor presents a name of a person to fill the vacancy, the council votes on it and there is a procedure to go to another meeting if that does not produce someone to fill the vacancy,” said Farnham.
