Former Franklin County Senator Norm McAllister to be tried for 3rd time on sex crimes charge

MONTPELIER, Vt. (WCAX) Former Franklin County Senator Norm McAllister (R) will face a third trial on sex crimes charge.

Prosecutors say they plan to move ahead after McAllister won a Vermont Supreme Court challenge last month seeking a new trial.

A jury last year convicted McAllister of prostitution charges by arranging to have a woman at his goat farm exchange sexual favors for paying her electric bill. He was acquitted of two more serious charges of sexual assault and prohibited acts.

But in his appeal, McAllister's lawyers argued the court committed "reversible error" because it allowed prior bad acts from previous incidents and retroactively instructed the jury to disregard evidence from the trial during deliberations. The high court agreed,
