False Election Filings Case Can Move Forward, State's High Court Rules

The West Virginia Supreme Court of Appeals has ruled indictments against two candidates charged with falsifying their election filings can go forward.

Court documents allege when Jan Hite King and Kimberly Maynard ran for the Cabell County Commission in 2022, they each certified they lived in Magisterial District 1.

An investigation by the Secretary of State’s office found King lived in District 2 and Maynard in District 3. They were indicted for false swearing, aiding and abetting each other, and conspiracy – for a total of five misdemeanor counts.

But the fairly rare cases took time to investigate, and the indictments weren’t returned until April 2025. A lower court found the statute of limitations was just one year and had already run out.
