Judge Birch also had a few choice words about the proverbial "activist judge" of whom members of the religious Right so often complain – an epithet they were likely to hurl at the Eleventh Circuit. Birch defined an activist judge as "one who decides the outcome of a controversy before him or her according to personal conviction, even one sincerely held, as opposed to the dictates of the law as constrained by legal precedent and, ultimately, our Constitution." Birch said that if the courts were to "change the law" in the Schiavo case at the bidding of Congress and the Schindlers, then "an 'activist judge' criticism would be valid."
