was a bad decision.

This doctrine allows an un-elected bureaucracy to establish de facto law.

The sets up a situation that encourages Congress to kick the can down the road and avoid any responsibility on hot button political issues rather than face it head on and, IDK, actually take a stand, make a decision and lead.
