The Yellen case appears to say that this comes down to whether the NLRB exercises executive authority (which it pretty clearly does).

The day of the 2016 election I had dental surgery, voted on the way home with my face still half numb. I filled in the circle for my former senator so many times that I was lucky I didn't create a "hanging chad." But I never doubted she'd win, her opponent was an offensive jerk. I fell asleep on the couch watching the returns and woke up at about 3am to see TFG standing there with his entire extended family. I was sure that I was having a bad dream - and now that he's a convicted criminal and tried to overthrow the government, it's just getting worse. Who would vote for that??
