(15,595 posts)45. Numerous federal district courts, including Washington D.C., have found citizens have a First Amendment right
to record law enforcement while performing their duties in public. Trump's declaration of "direct federal control" of the district doesn't mean these First Amendment rights no longer exist. However, under the Home Rule Act Congress retains the power to review, modify, or overturn local legislation and can impose new laws on the District. While District residents still have their First Amendment rights, Congress could limit or regulate their exercise, but that would be subject to judicial review and could be challenged on constitutional grounds. Like all of Trump's many crimes, this will also have to be decided by the courts.
