than with a republican taking over that seat between now and January 3. Either vacant or a republican are the two most likely scenarios. If Beshear tries to appoint a Democrat it will be tied up in court over his authority to do so and in the meantime, the Senate republican majority will refuse to seat Beshear's appointee unless its a MAGA republican.
