The state Constitution gives him authority to fill vacancies by temporary appointment. But if read literally to apply to federal as well as state offices it would conflict with the US Constitution's provision governing filling House vacancies. A court, seeking consistency, could very well interpret the state constitution provision as applying only to state officials and not federal.
